Artist Agreement

The terms that apply specifically to artists who create a profile on VibrArte: your relationship with VibrArte, profile obligations, content rights, membership fees, booking responsibilities, payouts, conduct rules, suspension, and cancellations.

Relationship with VibrArte

By creating an artist profile on VibrArte, you act as an independent contractor. You are not an employee, partner, joint venturer, or agent of VibrArte, and this Agreement does not create an employment relationship of any kind between you and VibrArte.

You set your own pricing, availability, and service descriptions, and you are solely responsible for the performance you provide to clients. VibrArte does not direct or supervise how you perform your services; VibrArte operates the marketplace that connects you with clients.

Artist Profile Obligations

You agree to keep your public profile β€” including your name, categories, bio, services, pricing, availability, and media β€” accurate, current, and a fair representation of the services you actually offer and can deliver.

Publishing your profile is self-service: VibrArte does not review or approve your profile before it goes live, and publishing requires at minimum a display name, at least one category, and at least one profile photo. VibrArte is notified automatically whenever you publish, and may review your profile at any time against these obligations and the conduct rules described below.

Content Ownership and License

You retain ownership of the photos, videos, descriptions, and other content you upload to your profile and gallery. By uploading content, you grant VibrArte a limited, non-exclusive license to display that content on the platform β€” including artist cards, search results, and your public profile page β€” for as long as your profile remains published.

You are responsible for ensuring you have the right to upload and display any content on your profile. Removing content from your profile, or unpublishing or deleting your profile, ends VibrArte's license to display that content going forward.

Membership Plans and Fees

VibrArte offers a free Standard tier and paid membership plans β€” Elite and Platinum, billed on a recurring monthly or yearly basis through Stripe β€” plus a Diamond tier. Your membership tier determines the commission VibrArte collects from your side of each booking: Standard 5%, Elite 4%, Platinum 2.5%, and Diamond 0%. This commission is deducted from the amount paid out to you.

You can manage or cancel a paid membership through the billing controls in your dashboard. Plan changes take effect according to the billing cycle in place at the time of the change. These rates are the rates in effect as of this document's effective date and may be updated by VibrArte from time to time; any change applies to bookings accepted after the change takes effect.

Booking Responsibilities

When you send a quote in response to a client's event request, you are responsible for the price and scope you propose. A booking is confirmed the moment the client accepts your quote β€” confirmation happens independently of, and before, payment is completed β€” and you agree to honor a confirmed booking as quoted.

Once a quote is accepted, a contract reflecting that quote is generated on the platform, snapshotting the agreed terms and pricing. You are responsible for fulfilling the obligations set out in that contract for each confirmed booking.

Payments and Payouts

Client payments and your payouts are processed through Stripe. VibrArte does not store card numbers or other full payment card details.

After a client's payment is confirmed, your payout β€” the accepted quote amount minus the applicable commission for your membership tier β€” is transferred to you through Stripe. Payouts may be subject to a holding period before funds are released, which VibrArte may apply for reasons including event timing and payment verification.

Platform Conduct Rules

You agree to use VibrArte honestly and professionally: representing your services accurately, communicating in good faith with clients, and not using the platform to harass, defraud, or mislead clients or other artists.

If you are on the free Standard tier, your published bio, headline, and service descriptions may not contain a directly detectable email address or phone number β€” this restriction does not apply to Elite, Platinum, or Diamond artists. Attempting to route clients away from the platform to avoid VibrArte's fees is a violation of this Agreement regardless of membership tier.

Suspension and Termination

VibrArte may suspend or ban your account if you violate this Agreement, engage in prohibited conduct, or pose a risk to the platform, clients, or other artists. A suspended or banned account is immediately removed from public search and profile pages, and you lose access to profile editing, media uploads, and other artist-editor actions until the account is restored.

You may unpublish, close, or permanently delete your own artist profile at any time through your dashboard. VibrArte will restore a suspended account when it determines the concern has been resolved; a ban is a more persistent action than a suspension.

Cancellations and Disputes

Booking cancellations are handled manually, on a case-by-case basis, by VibrArte. There is no automatic or self-service cancellation process, and no fixed refund percentage or schedule; each request is reviewed individually and any refund is determined at VibrArte's discretion based on the circumstances of the booking.

A dedicated dispute-resolution workflow is not built into the platform today. If a disagreement arises between you and a client about a booking, contact VibrArte directly with the booking details; VibrArte will review the matter manually using the cancellation and refund tools described above.

Agreement Changes and Governing Terms

VibrArte may update this Agreement from time to time; the version and last-updated date at the top of this page reflect the version currently in effect. Continuing to maintain a published artist profile after an update takes effect constitutes acceptance of the updated Agreement.

This Agreement works alongside VibrArte's Terms of Service and Privacy Policy, which continue to apply to your use of the platform. The governing law and jurisdiction for this Agreement have not yet been finalized and will be added in a future update to this document.
