Platform Overview
VibrArte operates as a marketplace that connects clients seeking live music and entertainment with independent artists who offer those services. VibrArte is not the performer, and it does not employ, direct, or supervise the day-to-day work of any artist listed on the platform.
Artists who create profiles on VibrArte are independent contractors, not employees, partners, or agents of VibrArte. Each artist sets their own pricing, availability, and service descriptions, and is solely responsible for the performance they provide. Nothing in these Terms, and no feature of the platform, creates an employment, partnership, joint venture, or agency relationship between VibrArte and any artist or client.
Artist Profiles and Content Rights
Artists retain ownership of the photos, videos, descriptions, and other content they upload to their public profile. By uploading content, an artist grants VibrArte a license to display that content on the platform (including artist cards, search results, and the artist's public profile page) for as long as the profile remains published.
Artists are responsible for ensuring they have the right to upload and display any content on their profile, and for keeping their profile information (services, pricing, availability, and media) accurate and current.
Requests, Quotes, and the Booking Lifecycle
A client begins by submitting an event request describing the event, date, and desired service. The artist reviews the request and, if interested, sends a quote setting out the price and scope of the performance. The client may accept or decline the quote.
The booking lifecycle is: request, then quote, then client acceptance, then a contract reflecting the accepted quote, then payment. Each step is recorded on the platform, and messaging between the client and artist is available throughout the process to clarify event details.
Booking Confirmation
A booking is confirmed at the moment the client accepts the artist's quote. Confirmation happens independently of, and before, payment is completed. Once a booking is confirmed, the applicable service fee and commission are calculated based on the accepted quote amount.
Payments, Fees, and Commissions
Payments on VibrArte are processed through Stripe. VibrArte does not store card numbers or other full payment card details; Stripe handles payment processing on VibrArte's behalf.
When a client accepts a quote, VibrArte charges a client service fee of 8% of the artist's quoted amount, added to the total the client pays.
VibrArte also collects a commission from the artist's side of the same booking, based on the artist's membership tier: Standard 5%, Elite 4%, Platinum 2.5%, and Diamond 0%. This commission is deducted from the amount paid out to the artist.
These fee and commission rates are the rates in effect as of this document's effective date and may be updated by VibrArte from time to time; any change will apply to bookings accepted after the change takes effect.
Artist Subscriptions
VibrArte offers optional paid membership plans for artists, currently Elite and Platinum, billed on a recurring monthly or yearly basis through Stripe. A membership plan determines, among other things, the commission rate described above.
Artists can manage or cancel their subscription through the billing controls available in their dashboard. Subscription changes take effect according to the billing cycle in place at the time of the change.
Cancellations
Booking cancellations on VibrArte are handled manually, on a case-by-case basis, by VibrArte. There is no automatic or self-service cancellation process for clients or artists at this time. To request a cancellation, contact VibrArte directly with the booking details and the reason for the request.
Refunds
Refunds, when granted, are reviewed and processed individually by VibrArte. VibrArte does not apply a fixed refund percentage or schedule; each request is evaluated on its own facts, and any refund amount is determined at VibrArte's discretion based on the circumstances of the booking.
Artist Payout
After a client's payment is confirmed, the artist's payout (the accepted quote amount minus the applicable commission) is transferred to the artist through Stripe. Payouts may be subject to a holding period before funds are released, which VibrArte may apply for reasons including event timing and payment verification.
Liability Limitations
VibrArte provides the platform that connects clients and artists but is not a party to, and does not guarantee, the performance itself. To the fullest extent permitted by law, VibrArte is not liable for the conduct, quality, timeliness, or outcome of any artist's performance, or for any dispute between a client and an artist arising from a booking.
The platform, and all services made available through it, are provided on an "as is" and "as available" basis, without warranties of any kind beyond those that cannot be excluded by applicable law.
Account Suspension
VibrArte may suspend or restrict an account that violates these Terms, engages in prohibited conduct, or poses a risk to the platform or other users. Where reasonably possible, VibrArte will provide notice of the reason for a suspension.
Governing Law
The governing law and jurisdiction for these Terms have not yet been finalized and will be added in a future update to this document.
